PLEASE READ THESE TERMS OF SERVICE CAREFULLY

These Terms of Service ("Terms") govern your use of the applications (the "Apps") developed and published by Jixway ("we", "us", or "our"). By downloading, installing, or using our Apps, you agree to be bound by these Terms. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE OUR APPS.

We reserve the right to make changes to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms. You are encouraged to periodically review these Terms to stay informed of updates. Your continued use of the Apps after the date such revised Terms are posted constitutes your acceptance of the changes.

1. USE OF THE APPS

Our Apps are available for download free of charge via the Apple App Store. You are granted a non-exclusive, non-transferable, revocable license to use the Apps for your personal, non-commercial use on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.

2. IN-APP PURCHASES AND SUBSCRIPTIONS

While our Apps are free to download and use, they may offer optional auto-renewable subscriptions ("Pro" or "Premium" versions) that unlock additional features and content.

Subscription Terms:

- Payment will be charged to your Apple ID account at the confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
- Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

Managing Subscriptions:

You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. We do not have the ability to manage, cancel, or refund your App Store subscriptions directly. All billing matters are handled entirely by Apple.

3. INTELLECTUAL PROPERTY

The Apps, including their original content, features, functionalities, and design, are and will remain the exclusive property of Jixway and its licensors. Our Apps are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Apps or included software, nor may you reverse engineer or attempt to extract the source code of that software.

4. USER CONDUCT

You agree not to use the Apps in a way that:
- Violates any applicable local, state, national, or international law or regulation.
- Explicits, harms, or attempts to exploit or harm minors in any way.
- Impersonates or attempts to impersonate Jixway, a Jixway employee, another user, or any other person or entity.
- Engages in any other conduct that restricts or inhibits anyone's use or enjoyment of the Apps, or which, as determined by us, may harm Jixway or users of the Apps.

5. DISCLAIMER OF WARRANTIES

THE APPS ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE APPS AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APPS AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. LIMITATION OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APPS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
